The Department of Business Development now asks Thai shareholders and directors for bank statements when company filings are made, and checks that the money actually moved. Surat Thani is in the first group of provinces under review.

Buying and ownership
Can a foreigner own property on Koh Samui?
Not land in your own name. You can own an apartment freehold if it falls within the building’s foreign quota of 49 % of the total unit area.
For villas and land the usual routes are a registered lease of up to 30 years, a superficies that lets you own the house separately from the land, or a Thai company with genuine Thai shareholders. We explain which route fits before you make an offer.
What is a Chanote, and which title deeds should I avoid?
A Chanote (Nor Sor 4 Jor) is the strongest title: full ownership with surveyed boundaries, registered at the Land Office. A Nor Sor 3 Gor also allows a sale or a registered lease, but its boundaries are less precise; it can often be upgraded.
Plots held on weaker documents such as Sor Kor 1 or Por Bor Tor 5 cannot be transferred safely, and we advise against them.
What does buying cost on top of the price?
At the Land Office: a 2 % transfer fee on the officially appraised value, either 3.3 % specific business tax (if the seller has owned the property for less than five years) or 0.5 % stamp duty, and withholding tax on the seller’s side. Who pays what is agreed in the contract.
Registering a lease costs 1 % of the total rent plus 0.1 % stamp duty. Legal and accounting fees come on top and are quoted in writing.
Who pays the agent’s commission?
The seller. As a buyer you pay nothing for the real estate side. Legal and accounting work is billed separately, and you get the quote in writing before we start.
How long does a purchase take?
For a resale property, usually four to eight weeks from accepted offer to transfer at the Land Office. Most of that time goes into the title search and moving funds from abroad. Off-plan purchases follow the construction schedule.
Can I buy through my own Thai company?
Only if the company is genuine: Thai shareholders must hold at least 51 % and invest their own, traceable money. Using nominee shareholders is a criminal offence.
Since 1 August 2026 the Department of Business Development checks bank statements of Thai shareholders and directors when filings are made, and Surat Thani is among the provinces under review. We set up companies that pass these checks, or recommend a lease instead.

What does your title search cover?
Ownership and boundaries at the Land Office, mortgages, leases and servitudes registered against the plot, legal access to a public road, any court orders on the title, and the building permit compared with what was built. You get a written report in English before you pay a deposit.
Is a 30-year lease renewable?
Thai law limits a registered lease to 30 years at a time. A renewal option can be written into the contract, but it is a promise by the current owner and is not registered automatically. We draft leases so your position is as strong as the law allows, and we explain the limits plainly.
Do I need a Thai will?
If you own assets in Thailand, a Thai will makes it much simpler for your heirs to deal with the Land Office and Thai banks. It covers only your Thai assets and is written to sit alongside your will at home.
Accounting and tax
What does a Thai company have to file each year?
Monthly withholding tax returns, VAT returns if it is registered for VAT, and social security if it has staff. Twice a year corporate income tax (PND 51 and PND 50). Once a year audited financial statements, approved at a shareholders’ meeting within four months of year-end and submitted to the DBD within one month of that meeting.

Do I pay tax on rental income from my villa?
Yes. Rental income from property in Thailand is taxable in Thailand, whether or not you live here. We calculate the tax with the deductions you are entitled to and file the return. Renting by the night also raises licensing questions, which our lawyer can answer.
